Still say it's a Western Fence Lizard, especially with that short neck!! Lol. And that littttle patch of blue under his neck... (proooobably a male!)
Temps need to be 80-90ºF (I'd say 85-88ºF) during the day, and 70-75ºF at night. As for basking, a website suggested to use a 75w house bulb (w/e the heck that means! so many types of "house bulbs").
So what I got from the crude breakdown for advice was 80ºF-90ºF on the hot side (use a UTH and a day bulb... ), 75ºF cool side, and turn everything off at night if your house is 70-75ºF ambient.
They eat bugs (crickets, mealworms, roaches)...spiders...all that good stuff. Dusting their food will prove to beneficial as well. They don't eat veggies.
As for an enclosure, find a little place to bask on...not a rock, but probably some wood. They like to cling to things...they're good climbers. And they're really agile. But have maybe a hide with some wood laying against it...give him a lot of places to hide and climb behind, on, under, around, up, down (you get the idea!). He might need at LEAST a 20 gal long (15 gal seems to be the consensus for minimums, but you know...bigger=better). Of course he'll need a water dish...UTH, light dome...
Substrate...someone suggested 4:1 reptibark to sand... but I would use paper towel at the moment for quarantine purposes.
EDIT: Also mist the cage a little each day..preferably in the morning. They need a little humidity.

Thank you for your advice Cerra got him a basking light and hes really perked up and eaten some crickets!!! I am allowed to keep him too xx

tsuhei gave a lot of good advice.
But they are tough little buggers. I used to keep them on fine aquarium gravel, had the tank in a spot that got direct sun, with a heat rock and a couple hiding places. and being handled by a little kid, i'm surprised i had them for as long as i did. they were happy for years. But don't do what i did lol.

I've donated him to my university as I did not have the space to give him the enclosure he deserved!!! He's happy in his massive enclosure and I know my tutor (who is the reptile keeper) will take good care of him
